1. Acceptance of Terms
These Terms of Service govern your access to and use of Canvassed AI, including our website, commercial real estate data platform, listings map, data portal, data exports, application programming interfaces, account tools, subscriptions, trials, and related services.
By creating an account, accessing the platform, purchasing a subscription or export, using an API key, or otherwise using the services, you agree to these Terms. If you use the services on behalf of a company or other organization, you represent that you have authority to bind that organization.
2. Services and Data
Canvassed AI provides commercial real estate information, search tools, market intelligence, listings data, downloadable datasets, and programmatic data access. The services may include information aggregated, standardized, licensed, or derived from public sources, third-party providers, brokerage materials, user activity, and internal data processing.
We work to provide useful and current information, but real estate data changes frequently. You are responsible for verifying property details, availability, pricing, ownership, broker contact information, zoning, taxes, measurements, and other information before relying on it for business, investment, legal, or financial decisions.
3. Accounts and User Responsibilities
You are responsible for maintaining the confidentiality of your login credentials, API keys, and account access. You must provide accurate account information and promptly update it when it changes.
You are responsible for all activity under your account, including activity by employees, contractors, agents, or systems that use your credentials or API keys. You must notify us promptly if you suspect unauthorized access.
4. Subscriptions, Trials, Payments, and Exports
Some services require a paid subscription, one-time purchase, trial, metered API billing arrangement, or other commercial agreement. Payment processing may be handled by third-party providers such as Stripe.
Subscription fees, export prices, trial periods, usage limits, included records, API rate limits, billing intervals, renewal terms, and cancellation rules are shown at checkout, in your account, or in a separate written agreement. Unless otherwise stated, subscriptions renew automatically until canceled. Cancellations generally take effect at the end of the current billing period.
Data exports and API responses may be subject to record limits, field restrictions, download windows, usage caps, and additional commercial terms. Fees already incurred may be non-refundable except where required by law or expressly stated in a written agreement.
5. Data Use and API Restrictions
You may use the services and data for your internal business purposes, subject to your plan, permissions, and these Terms. You may not:
- Resell, sublicense, publish, or redistribute Canvassed AI data except as expressly authorized.
- Use automated scraping, crawling, harvesting, or bulk extraction outside approved platform or API access.
- Share API keys, bypass rate limits, circumvent usage controls, or attempt to access unauthorized fields or geographies.
- Use the services to build a competing commercial real estate data product without written permission.
- Use data in a way that violates privacy, anti-spam, consumer protection, real estate, or other applicable laws.
API access may be throttled, suspended, scoped, or revoked if we believe usage threatens service reliability, security, data provider obligations, billing integrity, or compliance with these Terms.
6. Acceptable Use
You may not misuse the services, interfere with platform security or availability, attempt to reverse engineer non-public systems, upload malicious code, probe for vulnerabilities without authorization, or use the services for unlawful, deceptive, harmful, or abusive activity.
We may suspend or limit access if we reasonably believe your use creates legal, security, operational, or reputational risk for Canvassed AI, our users, our vendors, or our data sources.
7. Intellectual Property
Canvassed AI and its licensors own the services, software, designs, workflows, compilation, normalized datasets, documentation, trademarks, logos, and other platform materials. Except for the limited rights expressly granted by these Terms or a written agreement, no rights are assigned or transferred to you.
If you provide feedback, suggestions, or ideas, you allow us to use them without restriction or compensation.
8. Third-Party Services
The services may depend on third-party infrastructure, payment processors, hosting providers, analytics providers, mapping services, email tools, data providers, and other vendors. We are not responsible for third-party services that we do not control, and your use of those services may be subject to their separate terms and policies.
9. Disclaimers
The services and data are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Canvassed AI disclaims warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance.
Canvassed AI does not provide legal, tax, investment, brokerage, appraisal, valuation, or financial advice. You should consult qualified professionals before making decisions based on platform data.
10. Limitation of Liability
To the maximum extent permitted by law, Canvassed AI will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or substitute services.
To the maximum extent permitted by law, our total liability for claims arising out of or relating to the services or these Terms will not exceed the amounts you paid to Canvassed AI for the services giving rise to the claim during the three months before the event giving rise to liability.
11. Indemnification
You agree to defend, indemnify, and hold harmless Canvassed AI from claims, damages, liabilities, losses, and expenses arising from your use of the services, your violation of these Terms, your misuse or redistribution of data, your violation of law, or activity under your account.
12. Suspension and Termination
You may stop using the services at any time. We may suspend or terminate access if you violate these Terms, fail to pay amounts due, create risk for the platform, or if continued access is no longer commercially or legally feasible.
Terms that by their nature should survive termination will survive, including payment obligations, data-use restrictions, intellectual property, disclaimers, limitations of liability, indemnity, and governing law.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules, except where applicable law requires otherwise.
14. Changes and Contact
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the services after changes become effective means you accept the updated Terms.
